What are the Bankruptcy filing requirements in Minnesota?
In the state of Minnesota the only requirements are that a potential filer should be a Minnesota resident for 3 months, and owe at least $5,000 in debt.
However, a previous bankruptcy filing may prevent you from filing.
You cannot file for bankruptcy again immediately, but after a few years you will regain the right to file.
After a Chapter 7 bankruptcy discharge you must wait 8 years before filing again, but in many situations you can file more quickly.
Remember:
You do not need to be:
- A US Citizen, or
- A permanent resident
To file for bankruptcy in the US.
It is enough that you live in the US and have debts that you cannot repay.
